Affiliate Program Terms and Conditions

Please read these Affiliate Terms and Conditions carefully before using the SSFeatures Affiliate Program operated by SSFeatures, LLC, a Nevada Limited Liability Company. Your use of the Affiliate Program is conditional upon your acceptance of these terms. If you disagree with any part of these terms, then you do not have our permission to use our Affiliate Program.

Qualification and Approval

The following types of persons or companies will be considered for our Affiliate Program:

SmartSheet consultants;
Bloggers;
YouTubers;
Web design agencies and freelancers;
Web development agencies and freelancers;
Marketing agencies and freelancers;
Administrators of social media groups; and
Other agency or business owner influencers.

If you or your company do not fit into one of the categories above, please contact us at [email protected] to express your interest as you may still qualify for the program.

We reserve the right to approve or reject any application for any reason or no reason, in our sole discretion.

Accounts

If you are approved as an affiliate, your affiliate account will be automatically linked to your SSFeatures account. You may view your promotional code, promotional link, and information about your customers in the Affiliate Dashboard in your SSFeatures account.

Additionally, if you are approved, your affiliate account will be linked to Rewardful. You may link your Paypal information in Rewardful, view your next payout, view payout history, and create new affiliate links and discount codes in the Rewardful dashboard.

Your affiliate information will be handled by Rewardful. Please read their Privacy Policy here to understand your rights. Please also read their Terms and Conditions here.

We reserve the right to terminate your affiliate and/or SSFeatures account(s) at any time for any reason or for no reason, in our sole discretion.

Commissions

Depending upon which arrangement is selected, you may receive a one-time commission payment or recurring payments. The payment arrangement agreed upon will be displayed in your Rewardful Dashboard.

In order to receive payment, you must either provide your PayPal account information in your dashboard or send a valid mailing address for payments to [email protected] prior to the payment processing date. All affiliate payments will be processed on the 1st day of each month. Sign-ups have a 30-day refund grace period before they are eligible. For example, if you sign up a customer on January 15th, you will receive your first payment for this customer on March 1st.

Recurring commissions will be paid for as long as the referral pays SSFeatures. Payments will be sent for successful transactions only. Transactions that have been refunded or charged-back do not qualify for commissions. If your account is terminated, you will no longer receive any commissions.

Inappropriate behavior

The following is a non-exhaustive list of the behavior that we find inappropriate and that may lead to the termination of your affiliate account:

Making false claims about SSFeatures or our products on posts or advertisements (for example, SSFeatures is not a law firm and claiming otherwise is not appropriate);
Spamming or sending promotions to persons without their consent;
Fraudulent transactions or self-referrals;
Posting or advertising on websites that promote illegal acitivities, gambling, violence, pornography or other similar material;
Failing to disclose our affiliate relationship in accordance with the Federal Trade Commission Endorsement and Advertising Guidelines;
Violating our intellectual property rights;
Using misleading text or images to incite others to sign up for SSFeatures;
Submitting your affiliate information to deals or coupon sites.

NO WARRANTY

WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, THE AFFILIATE PROGRAM, THE SSFEATURES PRODUCTS AND SERVICES, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

Damages

In no event shall SSFeatures, LLC nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Website; (ii) any conduct or content of any third party on the Website; (iii) any content obtained from the Website;(iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

If, despite the limitation above, SSFeatures, LLC is found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then the liability of SSFeatures, LLC will in no event exceed the service fees you paid to it in connection with such transaction(s) on this Website.

The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms of Use is found to have failed of its essential purpose. Indemnification

You shall defend, indemnify, save and hold harmless SSFeatures, LLC (and its contracted providers, agents, customers, servants, officers and employees) from and against any and all demands, liabilities, fines, losses, costs, claims or suit (actual or threatened), and expenses, including reasonable attorneys’ fees, court costs and other reasonable expenses of litigation (collectively “Liabilities”) asserted against or incurred by SSFeatures that arise out of or relate to any materials provided by you to others in reference to this Affiliate Program, any claims made by you to others in reference to this Affiliate Program, or any intellectual property infringements committed by you in reference to this Affiliate Program.

Governing Law, Dispute Resolution and Venue

These terms shall be governed and construed in accordance with the laws of Nevada, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect. These terms constitute the entire agreement between us regarding our Affiliate Program, and supersede and replace any prior agreements we might have had between us regarding the Affiliate Program.

Any controversy or claim arising out of or relating to these Affiliate Terms and Conditions including, without limitation, the interpretation or breach thereof, shall be resolved in a court of competent jurisdiction in Clark County, NA.
